Rule 21
Proceedings on appeals
(1) According to Section 12 of the Administration of Justice Act, 2048, if it is considered appropriate to repeat a case, the public prosecutor assigned to file an appeal or to plead in such a case, a draft of the petition related to repeating the case within ten days from the date of the judgment or final order from the Court of Appeal. It should be prepared and sent to the Attorney General.
(2) If it is appropriate to submit an application to the court or the Supreme Court that hears appeals in accordance with Section 16 of the Administration of Justice Act, 2048, based on an order or an interim order issued by a court, body or official, to file an appeal in such a case or to prepare a draft application to the government lawyer assigned to plead the case. Within 10 days of receiving the motion to file an appeal, the district attorney should send the appeal to the public prosecutor's office, and the appeal should be sent to the attorney general if the appeal is filed by the associate attorney of the public prosecutor's office. Appeal After receiving the proposal, the associate attorney of the public prosecutor's office or the attorney general, if he deems it appropriate, will make an application to the relevant court on behalf of the government of Nepal.
